The following terms and conditions are in covenant to your usage of our website. We request you to please wisely read these terms and conditions. These Terms and Conditions oversee your right of entry and use of this Site. Therefore, if you are using this site, you are restricted by these terms and conditions and to any added guidelines, boundaries, or instructions that may be posted in association with definite sections or services of this Site.
Ibex Packaging holds every right to make amendments to these terms and conditions and to this site as well as regardless of time and without any notice. However, it is suggested that you must read these terms and conditions thoroughly each time you visit the website for your own benefits.
EXCLUSIVE RIGHTS NOTICE AND TRADEMARKS
Copyright (c) 2019 Ibex Packaging. All rights are held in reserve. Therefore, it is forbidden to duplicate or republish any of the materials and software contained on the Ibexpackaging.com web site.
It is stated that you are entirely accountable for your use of content in amalgamation with any other pictures, illustrations, typescript or other materials you integrate into your Products. By accepting these terms and conditions, you agree that you will not take account of any script, image, design, trademark, service mark, or any copyrighted work of any third party in your Products unless you have acquired the appropriate permissions from the possessors. You warrant that your Products do not trespass any rights of any third party, including copyright, trademark, right of publicity or privacy, and will not libel or defame any third party, and that you have all required rights or permissions necessary to incorporate third party material into your Products.
ON-SITE CUSTOMER CONDUCT
You agree and accept that you shall not send, upload, post or distribute anything via our website any materials that are offensive, unauthorized or restrict other users from using our website or trespass the intellectual property rights or other proprietary right of Ibexpackaging.com or any third party. We do not regulate the contents forwarded by the user or customers of our website, and hence do not assure the accurateness, uprightness or excellence of the content. Under no conditions we will be answerable to you in any way for any content you may be bare to that you may find aggressive, offensive or intolerable.
All information, statistics, typescript, pictures, illustrations, messages and any other materials are the sole accountability of the person that produced such content. Hence you are answerable for all content that you send, upload, post or otherwise transfer via the website. You agree to obey with all local rules regarding online conduct and adequate content. Under no circumstances will Ibexpackaging.com™ be legally responsible to you in any way for any content you may be uncovered to that you may find aggressive, crude or intolerable.

You agree that you will be accountable for all orders placed or other activities that are in use through your registered account. When you, or someone to whom you have given access, places an order using your password, you grant Ibexpackaging.com™ the world-wide, in exclusive license to use, duplicate, sublicense, amend, familiarize, circulate, exhibit and generate imitative works from the content on the website and on the published product for the purposes of storing designs or processing print orders.
You grant that Ibexpackaging.com™ shall have the right (but not the obligation) in their sole freedom of choice to remove any content that infringes the terms of service or may otherwise be objectionable. Ibexpackaging.com™ may preserve content and may also disclose content if required to do so by law or in the case that such disclosure is needed to: (i) act in accordance with with legal process; (ii) implement the terms of service; (iii) answer to claims that the content disrupts the rights of third-parties; or (iv) protect the rights, property, or personal safety of Ibexpackaging.com™, its users and the community.
ARTWORK SEND IN BY CLIENTS
It is mandatory that all artwork or designs and illustrations must be provided in CMYK format and with a least resolution of 300 DPI. Ibexpackaging.com™ is not accountable for any color changes that occur in conversions from RGB to CMYK color modes. Ibexpackaging.com™ is also not responsible for images printed as fuzzy, distorted or pixilated due to customer provided artwork.
PRINTING PRODUCTS: PROOFING AND MATCHING
We necessitate the users and customers of our website to approve evidence (whether an electronic file or hard copy) of the printing products. All print jobs involve customer approval of the final art work and job specification sheet. Once an order has been placed, final artwork proofs and a job specification sheet will be sent to customers via email. Customers are responsible for rereading all details mentioned in the specification sheet, including delivery dates and or production swiftness, and confirm that all the customer necessities have been precisely noted. Ibexpackaging.com™ is not liable for any specifications and requests beyond what are noted in the final specification sheet. In accumulation, it is the responsibility of the customer to evaluate the final artwork proof as proofreading is the responsibility of the customer. Unintended changes can occur because of the various ways that files are prepared.
What is revealed on the final proof signifies what will be printed. Ibexpackaging.com™ strongly recommends that the proof be printed out entirely to check definite position, spelling, and other design elements. Ibexpackaging.com™ will not be responsible for any design or spelling issues that are not identified by the customer and conversed to Ibexpackaging.com immediately. After consent, the design file and job specifications will be forwarded to the production department and printed as it is.
Ibexpackaging.com™ is not liable for color matching or ink density on screen proofs approved by the customers. Screen proofs predict design layout, text accuracy, image proportion and placement, but not color or density. Ibexpackaging.com™ will try to match the gradient density of each color in duo-tone. Ibexpackaging.com™ is not liable for the final appearance of a duo-tone unless the customer orders a color match proof. In addition, application of lamination may affect or change the appearance of the printed colors. Ibexpackaging.com™ is not legally responsible for the final color appearance of a laminated product/s.
MATERIAL SUPPLIES
Kindly note that the paper/card stock used for printing for our products is not foodstuff grade. Any such necessity should be communicated in writing immediately. If you’ve any specific food grade necessity with regards to paper stock, please let us know before the placement of this order.
CUSTOMER IS SOLELY HELD RESPONSIBLE FOR ALL THE PROOF AND LAYOUT CONSENT PROCEEDING TO THE PRINTING.
Ibexpackaging.com™ is NOT ACCOUNTABLE for blunders in a printed product caused by any of the following:
Graphics Positioning or Assignment and Unfitting Font Usage
Spelling, Syntactic and Punctuation Inaccuracies
Wrong Die cuts, tears or Improper and Omitted Folds
Completed Product Dimension
COLOR CORRECTNESS AND HARDCOPY APPROVALS
Ibexpackaging.com™ will replicate color from submitted print-ready files as closely as possible. However, Ibexpackaging cannot guarantee color match and color density because of limitations in the printing processes, different properties of various printing surfaces, as well as neighboring image ink requirements.
The accuracy of color reproductions is guaranteed to be within 90% of the final proof you approved. Please note that Ibexpackaging can only guarantee color reproduction for your print-ready files if you order a hardcopy proof for an additional charge. Please note that Ibexpackaging is not responsible for color variations between submitted print-ready images and the actual artwork or product they represent.
PROTECTION AND CONSTRAINT OF LIABILITY
You approve that you shall insure and defend Ibexpackaging.com™ and all parties from whom Ibexpackaging.com™ has licensed portions of content, and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including rational legal fees and expenses arising out of or related to (i) your breach of these Terms and Conditions or (ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material you incorporated into Products that was not part of the standard Site Content.
LIMITATION OF LIABILITY
In no event shall Ibexpackaging.com or its licensors, suppliers, or vendors, their officers, directors, employees, or agents be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data, or profits, whether or not Ibexpackaging.com has been advised of the possibility of damage, arising out of or in connection with the use or performance of the site or of failure to provide products or services that you order from Ibexpackaging.com or its affiliates, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service.
In no event shall Ibexpackaging.com be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of this site or its content.
DELIVERY POLICY
An estimated delivery time will be provided to you once your order is placed. Delivery times are estimates and commence from the day you approve the final specification sheet of your order, rather than the date of order. Delivery times are to be used as a guide only and are subject to the approval of your order.
Unless there are exceptional circumstances, we make every effort to fulfill your order within 06 to 07 business days of the date of your order. Business day mean Monday to Friday, except holidays.
Please note we do not ship on Sundays.
Date of delivery may vary due to carrier shipping practices, delivery location, method of delivery, and the items ordered. Products may also be delivered in separate shipments.
REFUND POLICY
Due to custom nature of printing and packaging products and other facilities we provide, you need to update us at Ibexpackaging.com. We cannot grant a repay or credit to you; however, we will investigate the matter cautiously. Once an order has been placed successfully, no refunds are issued for any design services orders.
Even though all orders are exceptional, and sales are fixed, if we acknowledge a mistake done by us, we will reprint the order without any refunds and credits.
IN CASE OF ANY REIMBURSEMENTS
The customer must notify Ibexpackaging.com™ within 3 business days of order delivery of any defects, damage, or missing items discovered in the delivered products. Ibexpackaging.com™ will not be accountable for any claims for defects, damage, or missing items that are not filed within 3 business days of the delivery date.
In order to receive replacement products, customer must return (at their own expense) at least 99% of the received product within 10 days of the initial order delivery date. No returns will be accepted without prior written return consent from Ibexpackaging.com™.
All charges related to expedite printing (rush printing or shipping) are not going to be refunded, including those orders that are returned for any reason
DAMAGED AND LOST PACKAGES
Customers are responsible for investigating all parcels for any noticeable signs of damage or missing items (when compared to the items listed on the enclosed packaging slips or invoices) before accepting delivery. In case of damage or missing items, the customers should notify Ibexpackaging.com™ and the delivery courier immediately. Ibexpackaging.com™ will not be responsible for any damage or missing items claims that are not filed by the customer within 3 business days of order delivery. Ibexpackaging.com™ is not responsible for 3rd party shipping errors, omissions or damaged shipments.
Each ordered product is usually shipped with few extra pieces that are free of charge. Seldom order shipment may have slightly fewer pieces than ordered. Printing trade standards allow for underage or overages of up to 5%. Therefore, if exact quantity is needed, then it is suggested that customers should order 10% over the required quantity.
Additional shipping and handling charges will be assessed for packages that have to be reshipped since an error was made by the customer in submitting the proper shipping address.
DISCLAIMER OF SERVICE CONTRACT
The site and its content are provided “as is” without warranty of any kind, either expressed or inferred, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. You acknowledge that operation of the site may not be uninterrupted or error free. References and links to products or services of independent companies may appear on the site. These references and links are provided “as is” without warranty of any kind, either expressed or implied.
ORDER SHIPPING AND DELIVERY
After final proof approval the products will be shipped in the least possible time. Product delivery time can vary depending on various factors including geographic location, transit availability, climate and more.
In all cases, final proof approval must be received by 11:00 AM EST otherwise one business day will be added to the shipping times.
Ibexpackaging.com™ will always act to print and ship orders in a well-timed manner. In no case shall Ibexpackaging.com™ be liable for any consequences or compensations resulting from any delay in the production, shipping, or delivery of the ordered products.
All Ibexpackaging.com™ customers agree not to hold Ibexpackaging.com™ liable for delays in shipments caused by technical issues, weather conditions, shipping company delays, international customs issues, or any other circumstances beyond Ibexpackaging.com™ direct control.
Ibexpackaging.com™ shipment and delivery dates are calculated based upon estimates provided by our suppliers and recent order history.
Ibexpackaging.com™ will always act to make sure that delivery schedules are met. However, unpredicted equipment failure, error or technical problems may delay the printing or shipping processes. In case of delays in the printing or shipping processes, rush charges or accelerate fees will be refunded or waived where applicable. Orders cannot be cancelled due to delays in the printing or shipping processes.
All Ibexpackaging.com™ customers agree to pay all customs duties and fees on good that are shipped to their respective locations. It is the accountability of the customers to make schedules to clear customs for shipments supplied outside the United States.
